Petitioners apprehend their arrest in Madanpur P.S. Case No.233 of 2018 registered under Section 308 and other minor sections of the Indian Penal Code.

The informant Bhimsen Singh named the petitioners and alleged that they all came and assaulted him with lathi on his head causing head injury.

Learned counsel for the petitioners submits that there is a counter version being Madanpur P.S. Case No.232 of 2018. No specific allegation of assault is made against the petitioner. The informant got two injuries. Both injuries are lacerated and the doctor has found both the injuries simple in nature.

No.75396 of 2018(3) dt.21-01-2019 2/2 Considering the facts aforesaid and the allegations made against the petitioners and the fact that there is a case and counter case and the injuries sustained by the informant are simple in nature, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Madanpur P.S. Case No.233 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
