Mr. Anish Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-08-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 448, 354(B), 307, 504/34 of the Indian Penal Code.

3. As per the FIR, allegation against the petitioners is of outraging the modesty of the informant and assaulting her family members.

4. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no offence. No such occurrence as alleged has ever taken place. Petitioners have been falsely implicated in this case. Learned

Patna High Court CR. MISC. No. 53128 of 2024(2) dt.28-08-2024 2/2 counsel further submits that the petitioners have one criminal antecedent as mentioned in para-3 of the bail petition. He further submits that the injury was found to be simple in nature. It is a case and counter case between the parties and both are agnates. There is admitted family dispute between the parties.

5. Learned APP for the State opposes the prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Jagdishpur P.S. Case No. 311 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
