The petitioner is apprehending his arrest in connection with Hasanpur P.S.Case no.126 of 2009 , registered for offences punishable under Sections 341, 323, 307, 384, 448, 380, 504,506 and 34 of the Indian Penal Code.
Allegation as per FIR is of assaulting the informant and taking away Rs.5,000/- and earlier also they had demanded Rs.50,000/- from the informant.
Submission of the learned counsel for the petitioner is that so far this petitioner is concerned only allegation is that he caught hold the hand of the informant and further the police after investigation has not found the case true against the petitioner and submitted charge sheet only against Paramanand Gupta.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Rosera, district Samastipur in connection with Hasanpur P.S.Case No.126 of 2009, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
