Petitioners apprehend their arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 447, 448, 324, 307, 326, 379 and 504 of the Indian Penal Code. Allegation against two petitioners is that on their extortion others assaulted the informant threw acids. Submission is that the petitioners and the informant are agnates there is partition dispute and there is case and counter case between both sides and there is no specific overt act against these petitioners except making allegation of order giver and they have no criminal antecedent.

No.38881 of 2017 (2) dt.21-08-2017 2/2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Ashpuran Prasad and Lal Babu Prasad be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 4th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Madhuban P.S. Case No.142 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
