JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Sahebganj P.S. Case No. 320 of 2018, disclosing offences under Sections 406, 419, 420, 34 of the Indian Penal Code.

Allegation as per F.I.R. is that the an I.T.I. Institute, situated at Tilaiya Patti run by one Ajay Singh and Ajay Singh is the Trustee of the same and one Shambhu Saran was the Principal of the said institute and it is alleged that they were engaged in getting admission on receiving Rs.10,000/- from each student and saying that rest Rs.30,000/- will be taken later on. On enquiry and investigation, it was detected that recognition has not been accorded with the institution and the petitioner is also one of the partner.

Submission of learned counsel for the petitioner is

No.74933 of 2018(5) dt.11-04-2019 2/2 that whole allegation is against Ajay Singh and Shambhu Saran and except the allegation that the petitioner is also a partner, there is nothing against him and co-accused Ajay Singh has been granted anticipatory bail vide order dated 04.02.2019 passed in Cr. Misc. No.73675 of 2018.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, West at Muzaffarpur, in connection with Sahebganj P.S. Case No. 320 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
