This application for anticipatory bail arises out of Ekangarsarai P.S. Case No. 90 of 2020 for the offence punishable under Sections 341, 323, 324, 307, 325, 379, 504 and 506/34 of the Indian Penal Code.

In view of the fact that no specific allegation has been levelled against the petitioner nos. 1 and 3, this Court in inclined to grant anticipatory bail to the petitioner nos. 1 and 3. Let the petitioner nos. 1 and 3, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.4246 of 2021(2) dt.17-11-2021 2/2 Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Ekangarsarai P.S. Case No. 90 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

So far as petitioner no.2 is concerned, his prayer for anticipatory bail is rejected as specific allegation has been made against him. However, if the petitioner no.2 surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
