The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, it is stated by the informant that her sister-in-law (sautan) Sunita Devi and her two brothers Raushan Yadav and Anil Yadav entered into a conspiracy and murdered her husband. The informant is convinced that the accused persons have a hand in the killing of

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. The name of the petitioner transpired in the confessional statement of co-accused Gajendra Yadav and Raushan Kumar who have both been enlarged on bail vide order dated 16.11.2021 passed in Cr. Misc. no.7872 of 2021 and order dated 15.11.2021 passed in Cr. Misc. no.19003 of 2021. No incriminating material has been recovered from the petitioner's possession in course of investigation. The petitioner is in custody since 26.9.2020 and as per the instructions received, charges have been framed in the learned trial court. The petitioner undertakes to cooperate in the trial. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the material that has transpired in course of investigation, grant of bail to the above mentioned two co-accused Raushan Kumar and Gajendra Yadav on whose confessional statement the name of the petitioner transpired together with the petitioner having remained in custody for 1 year 7 months, the Court directs the petitioner to be enlarged on bail in connection with Bangaon P.S. Case no.43 of 2020 on furnishing bail bond of Rs.10,000/

Patna High Court CR. MISC. No.57285 of 2021(3) dt.09-05-2022 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Saharsa.
