2. The petitioner seeks bail in connection with Cyber P.S. Case No. 03/2024, registered for the offence under Sections 419, 420 and 379 of the Indian Penal Code and Section 66(D) of the IT Act.
3. The accused/petitioner is not named in the F.I.R. and is in custody since 30.11.2024.
4. As per FIR, the informant was asked to transfer Rs. 75,000/- to mobile number 7545829189 by some unknown persons introducing him as police personnels against release of his son arrested at Ranchi. Subsequent to the call, informant transferred Rs. 30,000/- to aforesaid mobile number.
5. Learned counsel appearing on behalf of the petitioner submitted that during investigation, it transpires that passbook,

No. 46992 of 2025(3) dt.14-11-2025 2/3 where the amount send by the informant was received is in name of one Lalu Kumar and this petitioner implicated only for the reason that his aforesaid mobile number was tagged with said account. While concluding argument, it is submitted that investigation of this case is already completed, for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.
6. Learned APP while opposing the prayer of bail submitted that the mobile number is belong to this petitioner.

Considering the aforesaid factual submissions and by taking note of fact as the passbook in issue is in name of coaccused Lalu Kumar, coupled with the fact that investigation of this case is already completed, where petitioner being man of clean antecedent, remains in custody since 30.11.2024 accordingly, petitioner above named, is directed to be released on bail in connection with Cyber P.S. Case No. 03/2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Khagaria/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS, with further conditions that:- (i) Accused/Petitioner shall cooperate in

No. 46992 of 2025(3) dt.14-11-2025 3/3 the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court, only on medical ground of the petitioner duly supported by the documents. (ii) That the petitioner shall not involve in similar nature of offence till the conclusion of trial, failing which, the State shall be at liberty to move before the learned Trial Court itself for the cancellation of bail bond of the petitioner.
