JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-03-2015 Heard learned counsels for the petitioner, informant and learned A.P.P. for the State.

The petitioner is languishing in custody since 12.10.2014 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

The informant was informed by his niece Puja Kumari that the petitioner and one Mahendra Ram are assaulting the father-in-law of the informant with fists and slaps as a result he succumbed to injuries.

It is submitted by learned counsel for the petitioner that post mortem report reflects no external or enternal injury and cause of death has not been ascertained. A statement has been made in paragraph no. 3 of the petition that the petitioner

Considering the fact that the accusation is not being corroborated by post mortem report, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. East Champaran at Motihari, in connection with Kesariya P.S. Case No. 227 of 2014.

Learned court below will be liberty to cancel the bail bond of the petitioner if he defaults for two consecutive occasions.
