The appellant is apprehending his arrest in connection with Kudhni (Turki OP) P.S.Case no.470 of 2018 , registered for offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code and Section 3(1)(r)(s) of SC/ST (POA) Act.
Allegation against the appellant is of assault by knife at the chest of the informant causing injury to him and abused the informant by caste name. Submission of the learned counsel for the appellant is that there is scuffle on the petty issue and the injury is of insignificance and earlier a case had been lodged by the sister -in-law of the appellant against the informant. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the appellant, above named, in the event of arrest or surrender before the
Patna High Court CR. APP (SJ) No.4615 of 2018 dt.28-02-2019 2/2 court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 11th Addl. Sessions Judge cum Special Judge, SC/ST Act, Muzaffarpur in connection with Kudhni (Turki OP) P.S.Case no.470 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
Accordingly, this application is allowed and the impugned order is set aside..
