2. The petitioner seeks bail in N.D.P.S. Case No. 26 of 2024 arising out of Karza P.S. Case No. 425 of 2023 registered under Section-414/34 of the Indian Penal Code and Sections8(c) & 21(b) of the NDPS Act.
3. In course of vehicle checking, the police official found the petitioner moving on the road in suspicious condition and one person came to him and seeing the police party, both of them started fleeing away but the petitioner was arrested and in course of search, 16 gms. smack like substance was recovered.
4. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. 16 gms of smack
Patna High Court CR. MISC. No.52106 of 2024(2) dt.31-07-2024 2/2 is said to have been recovered. The recovered contraband is less than commercial quantity. The petitioner is in custody since 1312-2023.
5. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, specially the fact that the petitioner has got no criminal antecedent and the recovered smack is less than commercial quantity, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Exclusive Special Court No.-1 (NDPS), Muzaffarpur in connection with N.D.P.S.
