The petitioner seeks bail in a case registered for offences punishable under sections 399, 402 of Indian Penal Code, Sections 25 (1-b) (a), 26 & 35 of Arms Act, under Section 3⁄4 of Explosive Substance Act and under Section 20/22 of N. D. P. S. Act.
Considering that no arms and ammunitions was recovered from the possession of the petitioner and he has been in custody since 20.05.2014 and co-accused Ranjan Kumar has been granted regular bail vide order dated 20.01.2015 passed in Cr. Misc. No. 2230/2015, let the petitioner, Avinash Kumar be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge, VI,
Patna High Court Cr.Misc. No.4840 of 2015 (2) dt.05-02-2015 2/2 Patna in connection with Fatuha P. S. Case No. 164/2014 (Spl. Case No. 43/2014) with following conditions :- I) One of the bailors will be the close relative of the petitioner.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
