JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioners seek bail in anticipation of their arrest in connection with Vaishali P.S. Case No. 173 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 353, 332, 333, 307 and 504 of the Indian Penal Code. Prosecution story is that police got information that two persons are selling toddy and reached at the place of occurrence and advised them not to sell toddy. It is also alleged that thereafter police went to another village and while returning 40-50 persons attacked the police party.
Submission of learned counsel for the petitioners is that they are ladies aged about 65 and 66 years respectively and they have falsely been implicated in this case having no specific

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali, in connection with Vaishali P.S. Case No. 173 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
