The petitioner is languishing in custody since 06.10.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
On recovery of dead body of the father of the informant it was found somebody killed by slitting his neck. During investigation suspicion was raised against the petitioner as the petitioner had apprehension that his son died due to the witch craft exercised by the victim for which petitioner threatened the victim.
It is submitted by learned counsel for the petitioner that the impugned order,though, reflects that the charge-

No.4685 of 2015 (02) dt.05-02-2015 2/2 sheet has been submitted under Section 302 of the IPC but except suspicion there is no cogent material against the petitioner and informant has retracted from the initial version and filed petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S.
