The petitioner seeks anticipatory bail in connection with Maker P.S.Case No. 62 of 2018, registered for offences punishable under Sections 457 and 380 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is of committing theft in the house of the informant and taking away cloths, ornaments and other articles and name of the petitioner transpired in course of the investigation and petitioner is an accused in two other cases in which one of them is of dacoity and other is of Arms Act.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if he surrenders before the Court below within a period of six weeks from the date of receipt of order and make prayer for regular bail, the same will be considered by the learned Court below on its own merit without being prejudiced by this order of this Court and if possible, to be disposed of on the same day.

This application is accordingly dismissed.
