The petitioner apprehends his arrest in connection with Complaint Case No. 522 (C) of 2015, registered under Section 498(A) of the Indian Penal Code.

The accusation is of torturing of the complainant/O.P. No.2 by her husband and in-laws due to non-fulfillment demand of cash of Rs. One Lakh, golden chain, colour T.V. and removed the complainant from her matrimonial house and also caused injury at her head.

Learned counsel for the petitioner submits that, in fact, due to ill behaviour of the complainant, wife of the petitioner, petitioner filed Matrimonial Case No. 277 of 2015 on 16.03.2015

Patna High Court Cr.Misc. No.12955 of 2017 (5) dt.10-10-2017 2/2 before the Principal Judge, Family Court, Patna, thereafter, only to give undue pressure the complainant filed the present case on 25.04.2015.

Learned counsel appearing on behalf of O.P. No.2 submits that since the Divorce petition has been filed by the petitioner against the Complainant/O.P. No.2 due to that reasons, the matter was referred to the Mediation Centre, Patna High Court, Patna for settlement of the dispute between the parties through one time settlement and petitioner was ready to give Rs. Two Lakhs as one time settlement, but O.P. No.2 demanded Rs. 10 Lakhs. Having regard to the facts and circumstances of the case and also the fact that Matrimonial Case No. 277 of 2015 is pending, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Danapur, Patna in connection with Complaint Case No. 522 © of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
