Learned counsel for the petitioner seeks permission to make necessary correction in Para 15 of the this petition within course of the day.

Counsel for the petitioner is permitted to make necessary correction in Para-15 of the this petition. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered in connection with Barh P.S.Case No.386 of 2020 for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.. As per the prosecution case, it is alleged that the police raided the house of this petitioner and from his house one

Patna High Court CR. MISC. No.58466 of 2021(2) dt.07-04-2022 2/3 country pistol and four live cartridges were recovered. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. So far recovery is concerned, it is made from the house of the petitioner and the same is joint family house. It is next submitted that petitioner is in custody since 05.04.2021 and the investigation has already completed and the charge sheet has been submitted. It is next submitted that petitioner has also been made accused in Barh P.S.Case No. 14 of 2020 under the Bihar Prohibition & Excise Act 2016, on which he is on bail. The learned A.P.P opposed the prayer for bail of the petitioner.

Having heard the rival contentions of the parties and taking into consideration the fact that, recovery has been made from the joint family house of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Barh in connection with Barh P.S.Case No. 386 of 2020, subject to the condition that one of the bailors will be the close relatives of the petitioner with further conditions which are as follows:-

(ii) He will remain present on each and every date of trial till disposal of the case.

(iii) He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. (iv) In the event of default of two consecutive dates without any cogent reason, his bail bonds will liable to be cancelled.
