The petitioner is apprehending his arrest in connection with Vaishali P.S.Case no.166 of 2018 dated 6.7.2018 , registered for offences punishable under Sections 147, 149, 302, 379 of the Indian Penal Code.

Prosecution story is that son of the informant was tied with the guava tree and the accused persons assaulted him and asked him to accept the crime and it is also said that the petitioner was also present there along with them, thereafter, the police was informed and they have killed the son of the informant.

Submission of the learned counsel for the petitioner is that as a matter of fact the deceased was caught for committing

Patna High Court CR. MISC. No.76690 of 2018(4) dt.09-07-2019 2/2 theft and the petitioner has falsely been implicated in this case, having no specific allegation against him.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Vaishali P.S.Case No.166 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
