2. Mr. Subodh Kumar Jha, learned counsel appearing on behalf of the Union of India submitted that in compliance of order dated 29.07.2024, till date, he has not received any instruction in respect of the action taken by the authority
Patna High Court CWJC No.16583 of 2012(6) dt.20-08-2024 2/3 concerned regarding decision of the appointment of the petitioner on compassionate ground on the Class-3 or Class-4 post.
3. He further submitted that it is admitted by the parties that the petitioner had applied soon after the death of mother of the petitioner, who had died in the year, 21.07.2004, therefore, the authorities are required to take action to consider the case of the petitioner considering his age as on date the financial hardship which he is continuously facing in accordance with the law.

In continuation of order dated 29.07.2024, I direct the authority concerned to consider the case of the petitioner in accordance with the law laid down by the Apex Court in case of Umesh Kumar Nagpal v. State of Haryana and Others reported in (1994) 4 SCC 138 and State of W.B. v. Debabrata Tiwari, reported in 2023 SCC Online SC 219 by determining the financial status of the family of the petitioner and if it is found that petitioner fulfills all the requisite criteria, I am constrained to direct the authority concerned to consider the claim of the petitioner within a period of six weeks' from the date of communication of this order considering the fact that the writ petition has been kept pending before this Court from the
Patna High Court CWJC No.16583 of 2012(6) dt.20-08-2024 3/3 year, 2012.
5. With the above observations/directions, the writ petition is disposed of.
