Petitioners are languishing in custody since 18.07.2014 in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act. Later on Section 414 of the Indian Penal Code has been added.

On the information that the miscreants are preparing to commit dacoity, raid was made by the police and from the possession of petitioner no. 1 namely Nageshwar Bind @ Naga Baba one country made loaded pistol and one live cartridges were recovered whereas from the possession of petitioner no. 2 namely Amirak Bind one

Patna High Court Cr.Misc. No.5370 of 2015 (2) dt.10-02-2015 country made loaded pistol and two live cartridges were recovered. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the nature of accusation and period under custody, let the above named petitioners, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Rajeevnagar P.S. case No. 114 of 2014.
