2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 305(e), 317(2), 111, 3(5) of the Bharatiya Nyaya Sanhita.
3. Petitioner is named in the F.I.R. with allegation that he is group administrator of a WhatsApp group Jay Shree Radhe, facilitating illegal mining of sand.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is neither driver nor owner of the seized vehicle in question and he has been made accused in this case only on suspicion. Petitioner is only alleged to be Admin of the WhatsApp group and he has got no concern with the alleged incident. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Nawada in connection with Warisaliganj P. S. Case No. 139 of 2026, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
