The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No. 204 of 2017 registered under Sections 406/420 of the I.P.C. pending in the Court of C.J.M., Madhubani.
Submission is that petitioner is a student. He is innocent and has falsely been implicated in this case. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the F.I.R. and in course of investigation, the witnesses have also supported the prosecution version.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.50796 of 2017 (3) dt.12-12-2017 2/2 case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
However, petitioner is directed to surrender before the Court below and pray for regular bail, which shall be considered sympathetically.
