The petitioner is languishing in custody since 09.10.2014 in a case registered for the offences punishable under Sections 394, 302 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that Rs.Fourteen Lakhs was being carried for putting in the ATM of HDFC at Chapra Kutchery was robbed by the miscreants by causing firearm injury to the guard Sohrab Mian, who subsequently succumbed to the injury. It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up only on suspicion and the petitioner admitted that co-accused Rakesh

Patna High Court Cr.Misc. No.6147 of 2015 (02) dt.16-02-2015 2/2 Mishra and others along with his cousin came prior to the occurrence to take tea at the house of the petitioner and apart from that he is not aware about any planning to commit robbery. It is submitted by learned counsel for the informant that during investigation it transpired from the confession of co-accused that the planning for committing robbery was made in the house of this petitioner. Moreover, charge-sheet has already been submitted under Sections 396 and 120B of the IPC.

Considering the fact that except of confession of the co-accused no material has been placed before this Court suggesting the petitioner complicity in the crime, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 244 of 2014.
