The petitioner has renewed his prayer for grant of regular bail in a case registered under section 392 of the Indian Penal Code .

As per the prosecution case, the vehicle of the informant was overtaken by another vehicle, he was forced to inhale an intoxicating substance as a result of which he became unconscious and the accused persons looted the vehicle as also the articles in the car.

It is submitted by learned counsel for the petitioner that the petitioner was falsely implicated in the case in course of investigation. The earlier prayer for bail of the petitioner was rejected vide order dated 16.5.2022 (Annexure-1) passed in Cr. Misc. no. 63291 of 2021 giving liberty to the petitioner to renew

Patna High Court CR. MISC. No.48220 of 2022(2) dt.28-09-2022 2/2 his prayer for bail after completing one year in custody. The petitioner is in custody since 10.8.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted to the petitioner in the earlier order of rejection dated 16.5.2022 together with the petitioner having remained in custody for more than one year, the petitioner is directed to be enlarged on bail in connection with Sarai Ranjan P.S. Case no. 116 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur.
