The petitioner apprehends his arrest in connection with Complaint Case No. 1403/2015 registered for the offences punishable under Sections 406 of the Indian Penal Code and 138 of N.I. Act.
Considering the submission of the parties that basically the dispute is with regard to bouncing of cheque of Rs. 3,50,000/-, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on
Patna High Court CR. MISC. No.2021 of 2021(4) dt.07-01-2022 2/2 furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Gaya, in connection with Complaint Case No. 1403/2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
This Court is of the opinion that the petitioner once having been granted bail, will try to delay the conclusion of the trial. Hence, the court below is directed to conclude the trial within a period of six months from today and submit a report in this regard before this court.
