JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 01-08-2025 Heard Mr. Bipin Kumar, learned counsel for the petitioner and Mrs. Dr. Indiwar Kumari, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Nayagaon P.S. Case No. 28 of 2025 instituted for the offence under Sections 115, 126(2), 109, 351(2), 352, 303(2) and 3(5) of B.N.S.
3. The case of the prosecution in short is that the goat of the informant has consumed some wheat of the petitioner due to which the petitioner knocked the informant down catching her hair. It is further alleged that she was also being assaulted with lathi-danda. It is also alleged that the petitioner pressed the neck of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no
Patna High Court CR. MISC. No.46512 of 2025(2) dt.01-08-2025 2/2 offence. He has falsely been implicated in this case. It has further been submitted that from perusal of the order of the trial Court, it will transpire that the informant has received two injuries that is swelling and bruise on the right shoulder and right hip respectively which is not grievous in nature. Petitioner is having no criminal antecedent.
5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner and has stated that the informant has been badly beaten and her neck was pressed by the petitioner.
6. Having heard learned counsel for the parties and considering the nature of injuries, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Nayagaon P.S. Case No. 28 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai, subject to the conditions as laid down under section 482 (2) of the B.N.S.S.
