JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 23.02.2015 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner happens to be husband of the informant and earlier he was granted provisional bail with condition that he shall take the informant with him but it appears that the petitioner failed to comply with the order of the court resulting non-confirmation of provisional bail and thereafter, petitioner is in jail custody since 1.12.2014.

Considering the aforesaid facts and circumstances as well as the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Araria in Narpatganj P.S. Case no. 53/2011.
