JUSTICE ARUN KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No.448 of 2017 registered under Sections 25(1-B)A, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that one of the co-accused, Mukesh Kumar Yadav, the son of his brother-inlaw resides with him and there is case of 498A of the Indian Penal Code with the informant's sister and the allegation of opening fire is against him and the recovery of the so called arms was from the rooftop of the petitioner's house.

Having considered the said facts and circumstances relating to recovery of arms from petitioner's house, prayer of his anticipatory bail stands rejected in connection with Sitamarhi P.S. Case No.448 of 2017, pending in the court of learned Chief

Patna High Court Cr.Misc. No.50086 of 2017 (2) dt.18-10-2017 2 /2 Judicial Magistrate, Sitamarhi.

However, the petitioner may surrender and seek regular bail which shall be considered on merit without being prejudiced by this order.
