Mr. Sanjay Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 31-07-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. Petitioners are in custody in a case registered for the offence under Section 310(2) of the B.N.S.
3. As per the allegation in the FIR, on 25.10.2024 when the informant was sitting in his shop situated at Daraila, in the meantime, at about 7:00 P.M, six unknown person entered in a shop with deadly weapon and pistol and shut down the shutter
Patna High Court CR. MISC. No.45764 of 2025(2) dt.31-07-2025 2/3 of shop and took Rs.55,000/- on the gun point and also assaulted him thereafter they fled away.
4. Learned counsel for the petitioner submits that petitioners are innocent and have falsely been implicated in this case. He next submits that name of the petitioner, namely, Sohan Kumar Mali @ Sohan Mali has been transpired in this case only on the basis of suspicion and no incrimination article has been recovered from his possesion. He further submits that investigation has already been concluded and chargesheet has been submitted but no TIP has held in this case by the Investigation Officer. He further submits that the petitioner, namely, Shatrughan Mali @ Gofa is not named in the FIR and his name has been transpired on the basis of confessional statement of the co-accused Sohan Mali (petitioner no.1). He next submits that petitioners are in custody since 28.04.2025 and 24.02.2025. He next submits that there is two criminal antecedent against the petitioner no.1 and one criminal antecedent against the petitioner no.2.
5. Learned APP for the State opposes the prayer for Regular bail of the petitioners.
6. In the light of the aforesaid facts as well as the submissions of the learned counsel for the petitioners, let the

No.45764 of 2025(2) dt.31-07-2025 3/3 above named petitioner be released on bail, on their furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Guthani P.S. Case No.298 of 2024 with a condition that petitioners will remain physically present on each and every date fixed by the learned Trial Court. (Ramesh Chand Malviya, J) Harshita/- U T
