JUSTICE SANDEEP KUMAR ORAL ORDER 02-03-2022 Seen the report of the Principal Judge, Family Court, Gaya. He has reported that no maintenance case has separately been filed by opposite party no.2. In fact, the petitioner has filed a divorce case viz. M.T.S. No. 419 of 2018 and the same is pending.
Learned counsel for the opposite party no.2 submits that now the opposite party no.2 has filed a maintenance case.
In that view of the matter, the Principal Judge, Family Court, Gaya, is directed to dispose of the maintenance case filed by the opposite party no.2 at the earliest preferably
Patna High Court CR. MISC. No.4451 of 2021(6) dt.02-03-2022 2/2 within a period of three months from today. While deciding the maintenance case, the Principal Judge, Family Court, Gaya, will follow the ratio laid down by the Apex Court in the case of Rajnish vs. Neha reported in (2021) 2 SCC 324. Accordingly, the case is consigned.
