In this case, the petitioner has been proceeded departmentally and, ultimately, the petitioner has been visited with the order of punishment contained in Memo No. 9959 dated 9.7.2015 having been awarded the punishment of censure and withholding of promotion for two years from the date of promotion.

Learned counsel for the petitioner submits that the effect of censure as well as stoppage of promotion is in the year 2018 but, the petitioner has already superannuated from service on 30.11.2017. However, the claim of the petitioner is that he should be given promotion from the due

Patna High Court CWJC No.7329 of 2016 dt.22-11-2018 2/2 date and, for that, he has also filed an interlocutory application, I.A. No. 7654 of 2017.

This Court is not giving any opinion on the claim of the petitioner. If the petitioner files any such an application, that will be looked into by the authority concerned and will take a decision in accordance with law within a period of four months from the date of filling of the application by the petitioner. With the aforementioned observation, this writ application is disposed of.
