2. The petitioner seeks regular bail in connection with Sessions Trial No. 69 of 2024, arising out of Mairwa P.S. Case No. 294 of 2022 for the offences registered under Sections 341, 342, 307, 302/34 of the Indian Penal Code and Section 27 of Arms Act.

3. Earlier, the anticipatory bail petition of the petitioner, vide order dated 28.08.2023 passed in Cr. Misc. No. 42129 of 2023 was rejected. Vide order dated 20.12.2024 passed in Cr. Misc. No. 33987 of 2024 the regular bail petition of the petitioner was dismissed as not pressed with liberty to file fresh

4. Learned counsel for the petitioner submits that petitioner is in custody since 26.09.2023 and out of 9 prosecution witnesses only 2 witnesses have been examined. There is no likelihood to conclude the trial in near future. Petitioner undertakes to co-operate in the trial and shall present on each and every date as and when required by the Trial Court.

5. Learned counsel appearing on behalf of the State and learned counsel for the informant oppose the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and slow progress of trial and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Siwan in connection with Sessions Trial No. 69 of 2024, arising out of Mairwa P.S. Case No. 294 of 2022, subject to following conditions:- (i) The petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive

(ii) The petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds.
