Petitioner apprehends arrest in connection with Arwal (Mahila) P.S. Case No. 07 of 2017 registered under Sections 376/457 of the Indian Penal Code pending in the Court of C.J.M., Arwal.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He has falsely been implicated in this case on account of land dispute and personal grudge. Both the parties are common ancestors. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner. During the course of investigation, the
Patna High Court Cr.Misc. No.35961 of 2017 (3) dt.31-08-2017 2/2 witnesses have supported the prosecution case. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner.
