Patna High Court CR. MISC. No.45072 of 2019(2) dt.22-07-2019 2/3 The petitioners seek anticipatory bail in connection with Alamganj P.S. Case No. 149 of 2019 for the offences alleged under Sections 147, 149, 323, 307, 354, 379, 508 and 506 of the Indian Penal Code.
Petitioners 1 to 6 are sons of petitioner no. 7. Learned counsel for the petitioners has submitted that all the petitioners belong to the same family. The informant is wife of elder brother of petitioner no. 7. Learned counsel for the petitioners has submitted that there are series of litigations pending between them, including criminal cases, details of which have been given in paragraph 3 of the application. There is allegation in the first information report against petitioner no. 7 of having assaulted the informant's son with an iron rod which hurt his back. There is allegation of assault against other petitioners also.
Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail.
Considering the nature of dispute between the parties, this application is allowed.
Let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Alamganj P.S. Case No. 149 of 2019 shall be
