Petitioner is languishing in custody since 16.06.2013 in a case registered for the offences punishable under Sections 328, 379, 411/34 of the Indian Penal Code. Accusation is of committing theft of the articles after intoxicating the informant. The petitioner was apprehending on spot.

It is submitted by the learned counsel for the petitioner that recovery was made from the possession of Fool Mohammad Mian, who has been granted bail vide Cr. Misc. No. 30321 of 2014.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.5380 of 2015 (2) dt.10-02-2015 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No. 192 of 2013.

Since, the petitioner is accused in one other case, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
