2. The petitioner seeks bail in connection with Naurangiya P.S. Case No. 24 of 2024 dated 26.03.2024 registered for the offence punishable under Sections 341, 323, 324, 307 and 302 of the Indian Penal Code.

3. Allegation against the petitioner is that he inflicted single knife blow in the belly of Mirtunjay Kumar (deceased), the son of the informant causing injury to him due to which he died during his treatment.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.50494 of 2024(3) dt.25-09-2024 2/3 case. It is submitted that the minor girl of the petitioner was found in the house of the deceased. Upon denial of marriage of daughter of the petitioner with the deceased, she went to the house of the deceased. It is submitted that there is a case and counter case between the parties. Counter case has been lodged by wife of the petitioner against informant's family and in the said complaint case date of occurrence is said to be 26.03.2024 in relation to kidnapping of petitioner's daughter, who is minor girl aged about 17 years. It is submitted that the matter relates to marriage of daughter of the petitioner, who is minor and whose marriage could not be performed with the son of the informant. It is submitted that the incident took place at the spur of the moment and petitioner had no intention to kill the son of the informant. Lastly, it has been submitted that the petitioner is in custody since 27.03.2024, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Since the charge against the petitioner is grave in nature, I am not inclined to grant bail to the petitioner at this

7. Accordingly, the prayer for bail of the petitioner is hereby rejected.

8. The Trial Court is directed to expedite the trial and take all endeavor to conclude the trial at the earliest, preferably, within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail.
