The petitioners seek bail in Naugachia (Kharik) P.S. Case No. 82/2013 registered under section s 147, 148, 149, 341, 323, 307 and 279 of the Indian Penal Code. Govind Pandit made allegation that Umesh Pandit and Mithilesh Pandit along with others came. Mithilesh Pandit assaulted him with iron rod on his head. Umesh Pandit the petitioner No.1 assaulted his son Pawan on his hand. Learned counsel for the petitioners submits that there is a case and counter case on account of assault made by the petitioner no. 2 Mithilesh Pandit, the informant got simple injury on his head and Upmesh Pandit is alleged to have assaulted

Patna High Court Cr.Misc. No.5494 of 2015 (2) dt.10-02-2015 2/2 Pawan on his hand. The doctor also opined the injury simple in nature.

Considering the fact that there is case and counter case on account of assault made by the petitioners the informant has got simple injury, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M, Naugachia (Bhagalpur) in Naugachia (Kharik) P.S,.
