2. The petitioner seeks bail in a case registered for the offence punishable under Sections 365, 376, 379, 34 of the Indian Penal Code.
3. Petitioner is said to have committed rape with the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He submits that occurrence took place on 16.07.2019 but the FIR has been lodged on 24.07.2019 after delay of 8 days without explaining any reasonable cause of delay. He submits that the petitioner had solemnized marriage with the informant
Patna High Court CR. MISC. No.51032 of 2024(3) dt.23-08-2024 2/2 on 12.02.2020 at temple and is living with the petitioner. He further submits that petitioner has one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 15.04.2024.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ghoswari P.S. Case No. 74 of 2019.
