Petitioner seeks bail in a case registered for the offence punishable under Sections 302, 120B, 201 and 34 of the Indian Penal Code.
Informant who is father of the victim has alleged that he married his daughter to Navin Kumar 7-8 years back and both were living in the house of one Ashutosh Kumar as tenant and on 03.05.2021, he came to know that her daughter has committed suicide by hanging herself. He suspected that his daughter has been killed by this petitioner along with two unknown accused persons.
Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere
Patna High Court CR. MISC. No.57592 of 2021(2) dt.30-03-2022 2/2 suspicion only. Petitioner has no concern either with the Informant or with the deceased and it is only alleged that petitioner was on visiting terms and used to go to the house of the deceased. Petitioner has got no criminal antecedent and is in custody since 25.05.2021.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Begusarai Muffasil P.S. Case No. 266 of 2021, with following conditions:-
(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.
(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
