Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners, being father-in-law and mother-in-law of the deceased, have been falsely implicated in the instant case by the informant with an allegation that his daughter was married to the son of the petitioners in the year 2023 and after marriage, accused persons including the petitioners were demanding a motorcycle on which the informant assured that he will fulfill

No.49506 of 2024(2) dt.18-07-2024 2/3 the demand once he absolved himself of the debt which he had incurred at the time of marriage, further on 26-2-2024, he received an information that the deceased was taken to hospital for treatment as she suffered illness, accordingly he reached the place of occurrence and saw the dead body of his daughter with marks of violence on the neck.

It is next submitted that petitioners have been falsely implicated in the instant case with general and omnibus allegation. It is next submitted that no doubt the daughter of the informant had died but whether petitioners were involved in the occurrence is subject matter of investigation. It is next submitted that husband of the deceased is in custody. It is also submitted that whenever any occurrence of the nature as alleged takes place, the entire family members are implicated in a mechanical manner. It is next submitted that petitioners will not abscond rather will cooperate in the investigation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.49506 of 2024(2) dt.18-07-2024 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Isuapur P.S. Case No. 61 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners, despite giving assurance to this court, are not cooperating in the investigation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
