JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-11-2022 Though, the present writ petition was filed for removing the encroachment made by the respondents by constructing a road over the raiyati land of the petitioner bearing Khata No. 879, Khesra No. 5293, Village-Bharwaliya, P.S.- Palanwa, District- East Champaran, however, a counter affidavit has been filed on behalf of respondents no.1 to 4, wherein in paragraph no. 6, it has been stated that the construction made over the private land of the petitioner has already been removed and an F.I.R. bearing Palanwa P.S. Case No. 156 of 2022 has also been lodged against the erring persons.

In such view of the matter, the learned counsel for the

Patna High Court CWJC No.17167 of 2021(2) dt.02-11-2022 2/2 petitioner submits that if the encroachment made over the private land of the petitioner has been removed, the petitioner does not wish to press the present writ petition any further. Accordingly, the present writ petition stands disposed off as not pressed.
