This application for grant of regular bail arises out of Govindganj Malahi P.S. Case No. 238 of 2019 (S.T. No. 698 of 2017), disclosing offences punishable under Sections 304B and 120B of the Indian Penal Code.
This is second attempt of the petitioner to seek regular bail. He is husband of the deceased and is in custody since 29.07.2019.
Learned Senior Counsel appearing on behalf of the petitioner informs this Court that the trial before the Court below has advanced and possibly only Investigating Officer is required to be examined.
Patna High Court CR. MISC. No.22660 of 2021(3) dt.29-11-2021 2/2 Learned counsel representing the Informant, on the other hand, has submitted that all the prosecution witnesses have been examined and the trial is being adjourned for examination of defence witnesses.
Be that as it may, considering the facts and circumstances, particularly, the situation where the trial is at advanced stage, I am no inclined to entertain this application for the present.
This application is, accordingly, rejected.
This Court expects that the trial Court shall expeditiously conclude the trial. If the trial does not conclude within six months, the petitioner shall have the liberty to apply before the Court below for his release on bail. It goes without saying that the petitioner shall be at liberty to renew his prayer for bail before this Court also thereafter.
