Permission is granted.
The application thus, stands dismissed as withdrawn as against petitioner nos. 2 and 5. Heard learned counsels for the petitioners and the State.
Petitioners apprehend arrest in connection with Mohania P.S. Case No. 261 of 2020 registered for the
Patna High Court CR. MISC. No.4759 of 2021(4) dt.22-10-2021 2/2 offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. There is case and counter case. Moreover, the matter has been compromised between the parties. The compromise petition has been brought on record as Annexure-4. Petitioners are man of clean antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 1, 3, 4 and 6, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of their personal bond to the satisfaction of Chief Judicial Magistrate, Kaimur in connection with Mohania P.S. Case No. 261 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
