The petitioner seeks bail in Jandaha P.S. Case No. 213 of 2013 dated 05.10.2013 instituted under Sections 25(1-B)(a) of The Arms Act, 3/4 of the Explosive Substances Act and 17/18 of the C.L.A. Act.

This is the second attempt for bail as earlier such prayer was rejected by order dated 15.07.2014 in Cr. Misc. No. 12299 of 2014.

Nothing has been brought to the notice of the Court to persuade it to reconsider the matter afresh and thus the application stands dismissed.

However, since the petitioner is in custody since 12.12.2013, the Court below is directed to expedite the trial and conclude the same within nine months positively.

The

Patna High Court Cr.Misc. No.11447 of 2015 dt.12-04-2016 2/2 Superintendent of Police, Vaishali is also directed to ensure that the prosecution witnesses are produced before the Court on the dates so fixed. It is made clear that it shall be the duty of the trial Court to ensure compliance of the order within the time frame indicated.

Registry shall communicate the order to the Court below as well as the Superintendent of Police, Vaishali through Fax also latest by tomorrow.
