JUSTICE SANJAY PRIYA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Nabinagar P.S. Case No. 144 of 2017 instituted for the offence under Sections-304(B)/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act. Petitioner is husband of the deceased. There is allegation against this petitioner that he used to commit torture with the daughter of the informant for demand of dowry. It is further alleged that the petitioner had illicit relationship with one Puja Kumari and he wanted to marry with that girl. The daughter of the informant has been murdered by this petitioner in the railway quarters.

In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered on its own merit without being prejudiced by this order.
