Mr.Rajiv Nayan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 05-09-2023 Heard learned counsel for the petitioner and learned counsel for the Additional Public Prosecutor for the state.

2. The petitioner apprehends his arrest in connection with Azamnagar P.S.Case No. 165 of 2023 instituted under Sections 420, 467, 468, 484 of the Indian Penal Code.

3. The allegation against the petitioner, who is Kisan Salahkar posted in Azam Nagar Block in the districtKatihar is that he had taken Rupees two lakhs for the purpose of bogus appointment of Indra Awas Sahayak. He prepared bogus selected candidates paper in which he has also used the bogus stamp, bogus signature of Vikas Ayukat, Katihar and forged office memo number for the said

Patna High Court CR. MISC. No.49830 of 2023(3) dt.05-09-2023 2/2 purpose and also accepted the said facts before the authority and thus he did illegal act of forgery and misconduct against the office Rules and Regulations.

4. Learned APP for the State Opposes the prayer for anticipatory bail.

5. Considering the facts and circumstances of the case and submissions of the parties, there is direct allegation against the petitioner of taking money for appointment, misusing stamp letter number, Signature of DDC and he has also accepted his offence before the B.D.O and the witnesses have also supported the prosecution case, this Court is not inclined to grant him anticipatory bail, accordingly his prayer for anticipatory bail stands rejected.

7. However, if the petitioner surrenders before the learned court below within four weeks from today and seeks regular bail , his bail petition shall be disposed of on merit without being prejudiced to the rejection of this anticipatory bail.
