====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 420, 467, 468, 478/34 of the Indian Penal Code.

3. It is alleged that these petitioners in connivance with other F.I.R. named accused persons fraudulently sold the land of informant and when informant protested, he was threatened with dire consequences.

4. Learned counsel for the petitioners submits that the petitioner No. 1 is alleged to be deed writer and petitioner Nos.

Patna High Court CR. MISC. No.52548 of 2024(2) dt.20-09-2024 2/2 2 and 3 are alleged to be witnesses of the sale deed. Petitioners are neither seller nor purchaser of the land in question. They are not beneficiaries of the alleged transaction. Moreover, dispute involved in this case is regarding sale and purchase of land which is purely civil in nature and informant has got alternative remedy before the court below. Petitioners have got clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, dispute and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gaya in connection with Civil Lines P. S. Case No. 60 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
