2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and sections 30(a)/38/41(i) of the Bihar Prohibition and Excise Act, 2016.
3. 15 litres of country made liquor and 7.550 litres of foreign liquor has been recovered from Sudha Milk Parlour and Chiku General Store.
4. It is submitted that no incriminating article has been recovered from conscious possession of this petitioner. Petitioner is not the owner of the said Milk Parlour or of the Chiku General Store. Petitioner claims clean antecedent.
5. Considering the facts aforesaid, the petitioner
Patna High Court CR. MISC. No.49257 of 2023(2) dt.23-08-2023 2/2 above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Exclusive Special Excise Court, Saran at Chapra in connection with Sonepur P.S. Case No. 900 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
