JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In the first information report, the informant claims that petitioner, too, fired on him and one Md. Nizam @ Dabloo Mukhiya but in course of investigation, at para-13 of the case diary, injured, Md. Nizam @ Dabloo Mukhiya stated that this petitioner got identified him as well as informant and thereafter some unknown persons opened fire on him and informant. Similarly, the further statement of informant was recorded at para 23 of the case diary in which the informant, too, stated that some unknown persons had opened fire on him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.12018 of 2015 (4) dt.06-07-2015 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Jyoti Prakash, Judicial Magistrate 1st Class, Patna in connection with Phulwarisharif P.S. Case No. 716 of 2013.
