JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Surajpura P.S. Case No. 54 of 2017 registered for the offence punishable under sections 341, 323, 504, 307/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that both sides are agnates and the controversy arose on account of admired land dispute between the parties. Petitioner has been implicated in this case due to dirty village politics. He has no criminal antecedent.
Learned Addl. P.P. appearing for the State and the counsel for the informant opposes the prayer for bail and submits that there is specific allegation of assault against this petitioner which is supported by the injuries sustained. During investigation also, materials have come suggesting complicity of
Patna High Court Cr.Misc. No.45276 of 2017(3) dt.04-12-2017 2/2 this petitioner in the alleged offence.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
